The petition of U.S. Bank Trust National Association, Petitioner, was filed in the 163rd District Court of Orange County, Texas on 19th day of April, 2022, against Justin Hetherwick, Respondent, numbered 180137-C. The suit request:
Defendant to be cited to appear and answer herein as to the following property:
Plaintiff U.S. Bank Trust National Association, not in its individual capacity but solely as Owner Trustee for RCF 2 Acquisition Trust, its successors in interest or assigns, by and through its attorney of record Joseph M. Vacek of Robertson, Anschutz, Schneid, Crane & Partners, PLLC, 5601 Executive Dr., Suite 400, Irving, Texas 75038, brought suit against Debbie Coltharp a/k/a Deborah Lynn Coltharp, April Coltharp, Jennifer Coltharp, Kimberylee Green, Justin Hetherwick, and The Unknown Heirs of Rondell R. Coltharp a/k/a Rondell Ray Coltharp, deceased and any other person claiming any subordinate right, title and/or interest in 662 W Bluff Rd, Orange, Texas 77632 (“Property”), and legally described as:
BEING A TRACT OR PARCEL OF LAND CONTAINING 1.34 ACRES OUT OF AND A PART OF THE RICHARD BALLEW SURVEY, ABSTRACT NUMBER 2, IN ORANGE COUNTY, TEXAS, AND BEING ALL OF A 0.50 ACRE TRACT RECORDED IN VOLUME 860, PAGE 251, OFFICIAL PUBLIC RECORDS OF ORANGE COUNTY, TEXAS, AND BEING ALL OF A 0.836 ACRE TRACT RECORDED IN VOLUME 1250, PAGE 494, OFFICIAL PUBLIC RECORDS OF ORANGE COUNTY, TEXAS, SAID 1.34 ACRE TRACT BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING AT A 1 1/2-INCH IRON PIPE FOUND AT THE SOUTHEAST CORNER OF SAID 0.836 ACRE TRACT, ALSO BEING THE SOUTHWEST CORNER OF A 1.00 ACRE TRACT RECORDED IN VOLUME 398, PAGE 186, DEED RECORDS OF ORANGE COUNTY, TEXAS;
THENCE, NORTH 02 DEG. 39 MIN. 14 SEC. WEST, (BASIS OF BEARINGS) ALONG THE WEST LINE OF SAID 1.00 ACRE TRACT FOR A DISTANCE OF 281.34 FEET TO A 1/2-INCH IRON ROD SET AT THE NORTHEAST CORNER OF SAID 0.50 ACRE TRACT, ALSO BEING THE SOUTHEAST CORNER OF A 0.50 ACRE TRACT RECORDED IN VOLUME 1359, PAGE 301, OFFICIAL PUBLIC RECORDS OF ORANGE COUNTY, TEXAS;

THENCE, NORTH 89 DEG. 31 MIN. 30 SEC. EAST, ALONG THE SOUTH LINE OF SAID 0.836 ACRE TRACT FOR A DISTANCE OF 208.92 FEET TO THE POINT OF BEGINNING AND CONTAINING 1.34 ACRES OF LAND.

BEING A 20.00 FOOT ACCESS EASEMENT OUT OF AND A PART OF THE RICHARD BALLEW SURVEY, ABSTRACT NUMBER 2, IN ORANGE COUNTY, TEXAS, AND BEING OUT OF AND A PART OF A 3.666 ACRE TRACT RECORDED IN VOLUME 1278, PAGE 582, OFFICIAL PUBLIC RECORDS IN ORANGE COUNTY, TEXAS, AND BEING OUT OF AND A PART OF A 0.50 ACRE TRACT RECORDED IN VOLUME 1359, PAGE 301, OFFICIAL PUBLIC RECORDS OF ORANGE COUNTY, TEXAS, SAID 20.00 FOOT ACCESS EA?EMENT BEING 10.00 FEET ON EITHER SIDE OF THE FOLLOWING DESCRIBED CENTERLINE;
BEGINNING AT A POINT IN THE SOUTH LINE OF SAID 0.50 ACRE TRACT BEING SOUTH 88 DEG. 24 MIN. 31 SEC. WEST, 35.47 FEET FOR A 1/2-INCH IRON ROD SET AT THE SOUTHEAST CORNER OF SAID 0.50 ACRE TRACT;
THENCE, NORTH 01 DEG. 33 MIN. 19 SEC. EAST, ALONG THE RESIDUE OF SAID 0.50 ACRE TRACT FOR A DISTANCE OF 80.31 FEET TO A POINT FOR CORNER;
THENCE, NORTH 05 DEG. 50 MIN. 48 SEC. WEST, ALONG THE RESIDUE OF SAID 0.50 ACRE TRACT AND THE RESIDUE OF SAID 3.666 ACRE TRACT FOR A DISTANCE OF 189.91 FEET TO A TERMINAL POINT IN THE SOUTH RIGHT-OF-WAY LINE OF A PUBLIC ROAD KNOWN AS WEST BLUFF ROAD.
